Our Listing Agreements do vary. We do recommend to our Seller Clients to allow us to offer a cooperative incentive to Buyer Agents. This posted incentive amount is available on this website under Company Listings, and is recommended to equal or exceed competing properties; however this amount may vary depending on the Sellers desire and ability. Per Utah REPC Section 5, Buyer Agents are instructed and required to have a Buyer Broker Agreement with their clients denoting the amount of incentive the Buyer Brokerage will receive upon closing. If the buyer agent commission ("BAC") offered as a cooperative incentive BAC is less than the amount on your Buyer Broker Agreement, The Buyer agrees to pay the difference at Closing. The Buyer and Buyer Agent may seek the difference in the REPC offer as with any other Buyer Closing Cost. (See: REAL ESTATE BROKERAGE PAYMENT ADDENDUM)

In the event of a short sale transaction, the Brokerage Fee allowed by Lender will be split evenly between Buyer and Listing Brokerage.

Utah Senate Bill 56, passed May of 2005 instructs all licensed agents, that they will represent their clients with certain minimum levels of service.

Licensee Conduct 6.1.11.2. A principal broker and licensees acting on his behalf who represent a buyer shall have a written buyer agency agreement with the buyer defining the scope of the agency.
